By purchasing on this website you are agreeing to be bound by the Terms and Conditions as explained below.
The Terms & Conditions detailed below are only relevant to items bought on this website or through our call center. They do not apply to items purchased in our retail stores. Your statutory rights are not affected.
"Buyer" means the person who buys or agrees to buy Goods on this website from Carter Bed Company Ltd T/A Elephant Beds.
""Goods" means all products listed on the order.
"Consumer" has the meaning given in section 12 Unfair Contract Terms Act 1977
"Special Items" means any Goods that are not held in stock by Carter Bed Company Ltd T/A Elephant Bedsand are ordered and/or manufactured specifically for the Buyer.
"Delivery" means the delivery of the Goods to the delivery address specified on the order.
Limitations of Liability
Our total liability in regard to the performance of this contract shall be limited to the value of the Goods.
Carter Bed Company T/A Elephant Beds shall not be liable for any direct, indirect or consequential losses, costs or expenses incurred or any consequential compensation arising out of the performance/or non performance of this contract.
Nothing in these terms and conditions excludes or limits liability for death or personal injury caused by negligence, fraudulent misrepresentation or any other liability which may not otherwise be limited or excluded under applicable law.
All contracts shall be governed by English & Welsh Law
Any order placed by the Buyer and accepted by Carter Bed Company Ltd T/A Elephant Beds is subject to the following terms and conditions.
Carter Beds Ltd T/A Elephant Beds retains the right to refuse any order that is subject to an error on its website and will in these circumstances reimburse the Buyer in full.
Carter Bed Company Ltd T/A Elephant Beds retains the right to investigate any order placed on this website that it suspects to be fraudulent, any such order will not be delivered until it is proven that that the order is bonafide. Should Carter Bed Compnay Ltd T/A Elephant Beds Ltd be unable to prove that an order is bona fide or to contact the Buyer then the monies will be refunded to the original card used to place the order and the order will be cancelled.
Risk and Ownership
The Goods shall be at the Buyer's risk once delivery has taken place. The Buyer must take all reasonable care of the Goods. Should the Goods be returned to Carter Bed Company Ltd T/A Elephant Beds having been damaged while in the Buyer's care, the cost of such damage will be recovered from the Buyer.
Ownership of the Goods will only pass when cleared funds have been received from the Buyer, regardless of whether delivery has taken place.
Description of goods
The description of the goods will be as specified within the confirmation e-mail and it is the Buyers responsibility to check that the Goods specified are as the Buyer intended to order.
All sizes given are approximate and the Buyer should satisfy them self that the goods will fit into the delivery address. The normal bed and mattress sizes (i.e. 3, 0" single 4'6" double and 5'0" king) refer to the sleeping surface only and the Buyer should check the overall dimensions given for each product.
There may be certain items included in the illustration of a product which are not part of the product and are not included in the product description and are not part of the order, (for example, curtains, rugs, bedding and bedside tables).
Payment in full is required at the time the order is placed and Carter Bed Company Ltd T/A Elephant Beds will collect the payment from SAGE PAY who hold the purchasing card details.
All Prices and charges on this site are in U.K. pounds and include any V.A.T payable at the prevailing rate.
Complaints relating to faulty Goods should be notified in writing within 7 days of the fault becoming apparent and should be addressed to Customer Services Department, Carter Bed Company Ltd,T/A Elephant Beds , The Old Warehouse, Penarth Rd ,Cardiff ,CF11 8TT or by e-mail to firstname.lastname@example.org
In the rare event that Goods develop a fault,Carter Bed Company Ltd T/A Elephant Beds retains the right to have the Goods repaired or replaced at Carter Bed Company Ltd T/A Elephant Beds discretion, and any delivery costs associated with the exchange of faulty Goods will be met by Carter Bed Company Ltd T/A Elephant Beds.
Where Goods are reported as faulty later than seven days after delivery, we reserve the right to arrange an independent inspection and if the Goods are found on inspection to not be faulty but the result of fair wear and tear, negligence or wilfull damage, Carter Bed Company Ltd T/A Elephant Beds retains the right to charge a minimum of £80 for the inspection to cover its costs plus travel expenses This charge will be agreed and paid for in advance of any inspection, and where an item is found to be faulty, then the purchase value of the faulty product will be refunded to the buyer within seven days of the inspection.
This charge will be taken from the debit/credit card used to purchase the Goods. The Buyer and Carter Bed Company T/A Elephant Beds shall both agree to be bound by the results of the inspection.
All Goods are guaranteed against faulty materials and workmanship for a minimum period of twelve months from the date of delivery.
If you are not happy with your purchase for any reason you can return it to us and we will refund you with the amount paid for that item less any reductions which may be applicable.
Returns must be notified to us in writing within 14 days of the delivery date and items must be unused, free from defects and returned in their original packaging.
Due to hygiene reasons we are unable to accept back any mattresses that have been removed from the original packaging.
Once we have received any returned items and checked them we will refund your money, less any shipping costs.
Please contact us within 14 days of delivery to let us know you wish to return any items. We will need to know your order number, the product name and size of the model you are returning and the date you ordered.
You may deliver the goods back to our warehouse or alternatively we can arrange collection at a minimum cost of £49 (depending on area) which we will deduct from the refund.
Please note this returns policy does not apply to items that have been specifically tailored to your requirements or special order items which may be subject to a restocking fee of 60%.
